2. Who can use Simple Sustenance

You must be at least 18 years old to create a Simple Sustenance account.

Please provide accurate information and keep it up to date.

You are responsible for keeping your account secure and for activity carried out through it. If you believe someone else has accessed your account, please let us know as soon as possible.

Simple Sustenance is for personal, non-commercial use unless we agree otherwise.

3. How Simple Sustenance works

Simple Sustenance uses the information you provide to help personalise your experience.

This may include information about:

• your food preferences and dislikes;
• dietary preferences or requirements;
• ingredients you have available;
• recipes and meals you save;
• the number of people you are cooking for; and
• other choices you make when using the service.

We may use this information to create meal plans, suggest recipes, generate shopping lists and provide other relevant features.

You remain in control of what you choose to cook, buy and eat.

4. Food, dietary requirements and allergies

Simple Sustenance is designed to make meal planning easier, but it is not an allergy-management, medical or professional dietary service.

If you have an allergy, intolerance, medical condition or other dietary requirement, you should always check ingredients, recipes, product labels and packaging yourself before buying, preparing or eating food.

This is particularly important where food is being prepared for:

• someone with an allergy;
• someone with a medical dietary requirement;
• children;
• someone who is pregnant; or
• anyone with specific nutritional needs.

We may use the information you provide to tailor suggestions, but automated suggestions can occasionally be inaccurate or unsuitable.

Ingredients, recipes and product information can also change over time.

You should never rely solely on Simple Sustenance where dietary safety is important.

If you need medical or professional dietary advice, please speak to an appropriately qualified healthcare professional or registered dietitian.

5. Food preparation and safety

Simple Sustenance provides meal ideas and recipes. You are responsible for safely storing, handling, preparing and cooking your food.

This includes checking:

• use-by dates;
• cooking instructions;
• food temperatures;
• product labels; and
• any relevant food safety guidance.

We do not provide medical, food safety or hygiene advice.

6. AI and automated suggestions

Some Simple Sustenance features use AI and automated technology.

For example, AI may help generate:

• meal plans;
• recipes;
• ingredient suggestions;
• ideas based on the food you have available; and
• other personalised content.

These suggestions are intended to help you plan. They are not guaranteed to be accurate, complete, nutritionally balanced or suitable for your circumstances.

AI can make mistakes.

You should review any suggestion before relying on it and remain responsible for deciding what to buy, prepare and eat.

AI-generated content should not be treated as medical, nutritional or professional advice.

7. Pantry scanning and images

Simple Sustenance may allow you to use your camera, upload an image or select a photograph to help identify food and ingredients.

You choose whether to use these features.

We may process an image to identify possible ingredients and create a suggested pantry list.

Image recognition is automated and may occasionally:

• fail to identify an item;
• identify the wrong item;
• suggest an incorrect ingredient; or
• miss an ingredient entirely.

You should check and edit any pantry list before relying on it.

Please do not use pantry scanning as the only way of checking ingredients where allergies or other dietary safety concerns are involved.

You keep ownership of the images you provide. You give us permission to process them as needed to provide the feature you have chosen to use.

8. Shopping lists and third-party retailers

Simple Sustenance may help you create shopping lists and, where available, link you to supermarkets or other third-party retailers.

Simple Sustenance helps you plan what to buy. Unless we clearly state otherwise, we do not sell, supply, fulfil or deliver food.

If you follow a link to a retailer or make a purchase, your purchase is directly with that retailer and subject to its own terms and policies.

We are not responsible for:

• product availability;
• prices;
• substitutions;
• product descriptions;
• ingredients or allergen information;
• delivery;
• product quality; or
• customer service provided by a retailer.

Prices and availability can change, and any cost shown in Simple Sustenance may be an estimate.

Always check the retailer’s website and the product label before completing a purchase.

9. Recipes and nutritional information

Recipes and nutritional information in Simple Sustenance are intended to be helpful guides.

Nutritional information may be based on ingredient data, recipes or information provided by third parties. It may occasionally be incomplete, inaccurate or out of date.

Recipe portions and nutritional values can also change when you:

• substitute ingredients;
• change quantities;
• use a different product or brand; or
• adapt a recipe.

You are responsible for checking whether a recipe is suitable for you and anyone you are cooking for.

10. Your use of Simple Sustenance

Please use Simple Sustenance fairly and responsibly.

You must not:

• use the service unlawfully or to harm others;
• access another person’s account without permission;
• interfere with the security or operation of the service;
• attempt to gain unauthorised access to our systems or data;
• scrape, copy or systematically collect data from the service without permission;
• copy, resell or commercially exploit Simple Sustenance or its content without permission;
• upload harmful software or code; or
• use automated tools in a way that could disrupt the service or other users.

We may restrict or suspend access where reasonably necessary to protect Simple Sustenance, our users or others.

11. Our content and your content

Simple Sustenance, including its software, branding, design and original content, is owned by or licensed to NK Digital Ltd.

We give you a limited, personal and non-transferable right to use Simple Sustenance for its intended purpose.

This does not give you permission to copy, reproduce, distribute or commercially use our content without our permission.

You keep ownership of the content and information you add to your account, such as your preferences, saved content and notes.

You give us permission to store and process that information as needed to provide and maintain Simple Sustenance.

This permission ends when the relevant content is deleted, except where we need to retain it for a limited period for legal, security or backup purposes.

If you send us feedback or ideas about Simple Sustenance, we may use them to develop the service without an obligation to compensate you.

12. Paid subscriptions

Some Simple Sustenance features may be available as part of a paid subscription.

Before you subscribe, we will show you the price, billing period and any other important terms that apply.

Subscriptions renew automatically at the end of each billing period unless you cancel them before the renewal date.

If you subscribe through the Apple App Store, Google Play or another app store, your subscription and payments are managed by that store. You can manage or cancel your subscription through your app store account, subject to its terms and cancellation rules.

If we offer a free trial or introductory price, we will tell you how long it lasts and what you will be charged when it ends before you start the trial.

We may change our subscription prices from time to time. If a price change affects an existing subscription, we will give you reasonable notice before the new price applies.

Unless the law requires otherwise, subscription payments are non-refundable. This does not affect any statutory cancellation or refund rights you may have.

13. Using the app

If you download Simple Sustenance through the Apple App Store, Google Play or another app store, you must also comply with that store’s terms and conditions.

The relevant app store provides the platform through which you download the app. Simple Sustenance itself is provided by us.

Where required, the app store’s terms may also apply to your use of Simple Sustenance.

14. Changes to Simple Sustenance

Simple Sustenance will continue to develop and improve over time.

This means we may add, change or occasionally remove features. We may also change the way existing features work.

We will try to give reasonable notice of significant changes where this is practical and where a change is likely to materially affect your use of the service.

We may also update these Terms from time to time. If we make a significant change, we will take reasonable steps to let you know.

The latest version will always be available through Simple Sustenance or on our website.

15. Availability and your data

We aim to keep Simple Sustenance available and working properly, but we cannot guarantee that the service will always be uninterrupted or error-free.

The service may occasionally be unavailable because of maintenance, updates, technical problems or circumstances outside our control.

We may temporarily suspend parts of the service to carry out maintenance, improve security or investigate a problem.

We take reasonable steps to protect the information stored in Simple Sustenance, but we recommend keeping your own copy of anything that is particularly important to you.

We are responsible for loss or corruption of your information to the extent it results from our failure to use reasonable care and skill.

16. Ending or suspending your account

You can stop using Simple Sustenance at any time.

You may also be able to delete your account using the features provided in the app or website.

Information about what happens to your personal information when you delete your account is explained in our Privacy Policy.

We may suspend or close an account where reasonably necessary, including where:

• these Terms have been seriously or repeatedly breached;
• we believe the account is being used unlawfully or fraudulently;
• we need to protect Simple Sustenance, our users or others; or
• we are required to do so by law.

Where appropriate, we will try to explain the reason for suspension or closure.

17. Our responsibility to you

We are responsible for providing Simple Sustenance with reasonable care and skill.

However, Simple Sustenance relies on information from users, food suppliers, retailers, technology providers and other third parties. We cannot guarantee that every recipe, meal plan, ingredient suggestion, nutritional value or other piece of information will always be accurate, complete or available.

We are not responsible for losses caused by:

• inaccurate or outdated information provided by a third party;
• changes to ingredients, recipes or product information;
• your decision to purchase from a third-party retailer;
• problems with products or services supplied by a retailer;
• your use of a third-party website or service; or
• your failure to independently check food, ingredients, labels or dietary suitability.

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

Nothing in these Terms affects your legal rights as a consumer.

19. Other legal information

These Terms, together with our Privacy Policy, form the agreement between you and us about your use of Simple Sustenance.

If we do not immediately enforce a right under these Terms, that does not mean we have given up that right.

We may transfer our rights and responsibilities under these Terms to another organisation where this does not affect your rights.

These Terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you may also have rights under the laws that apply where you live.
