These Terms apply whether you access Simple Sustenance through our website, the Apple App Store, Google Play or any future platform on which the Service is made available.

Throughout these Terms:

2. Eligibility
To use Simple Sustenance, you must:
- be at least 16 years of age;

We reserve the right to refuse access to the Service where we reasonably believe these requirements have not been met.

You remain responsible for all activity carried out through your account.
If you believe someone has accessed your account without permission, you must notify us immediately.
We may suspend access while investigating suspected unauthorised use.
5. Account security
Protecting your account is your responsibility.
You should:

- avoid reusing passwords from other websites;
- keep login credentials confidential;
- log out from shared devices;

Although we implement appropriate security measures, no internet-based system can guarantee complete protection against every possible security risk.
6. Subscriptions
Certain features of Simple Sustenance require an active paid subscription.

Available subscription plans, pricing and included features are displayed before purchase.
Subscription prices may change from time to time.
Any price changes will apply only to future billing periods unless otherwise required by applicable law.
7. Purchasing subscriptions
Subscriptions may be purchased through:
- the Simple Sustenance website;
- Apple App Store;
- Google Play.
The payment provider responsible for processing your payment depends on where your subscription is purchased.
- Website subscriptions are securely processed through Stripe.
- App Store purchases are processed by Apple.
- Google Play purchases are processed by Google.
Your purchase is also subject to the applicable payment provider’s own terms and conditions.
8. Automatic renewals
Unless cancelled before the end of the current billing period, subscriptions automatically renew.
By purchasing a subscription, you authorise the relevant payment provider to charge the applicable subscription fee at each renewal.
Renewals continue until cancelled.
You remain responsible for ensuring that your payment method remains valid.
Failure to process payment may result in suspension or termination of premium features.
9. Free trials
From time to time, we may offer free trials or promotional subscription periods.
Unless otherwise stated:
- free trials are available only to eligible users;
- only one free trial may be permitted per person or household;
- the trial automatically converts into a paid subscription unless cancelled before the trial expires.
We reserve the right to modify or withdraw promotional offers at any time.
10. Cancelling subscriptions
You may cancel your subscription at any time.
Cancellation prevents future renewals but does not normally affect the remainder of your current subscription period.
Website subscriptions purchased through Simple Sustenance may be cancelled through your account settings.
Subscriptions purchased through Apple App Store or Google Play must be cancelled using the relevant app store’s subscription management tools.
Deleting your account does not automatically cancel an active subscription.
Users remain responsible for cancelling subscriptions through the appropriate billing platform before deleting their account.
11. Refunds
Refunds are governed by our separate Refund Policy.
Where subscriptions are purchased through Apple App Store or Google Play, refund requests must normally be submitted directly to the relevant app store.
Website subscriptions processed through Stripe may be eligible for refunds where required by applicable consumer protection legislation or where we determine that exceptional circumstances apply.
Nothing in these Terms limits any statutory consumer rights that cannot lawfully be excluded.
12. Service availability
We aim to provide a reliable and high-quality service.
However, we do not guarantee that the Service will always be available without interruption.
From time to time, access may be affected by:
- maintenance;
- software updates;
- security improvements;
- hardware failures;
- internet connectivity issues;
- third-party service interruptions;
- circumstances beyond our reasonable control.
Where reasonably practicable, we will seek to minimise disruption and restore normal service as quickly as possible.
Temporary interruptions do not normally entitle users to refunds or compensation except where required by applicable law.
13. Future improvements
Simple Sustenance is continually evolving.
We may introduce:

- AI improvements;
- accessibility enhancements;
- subscription tiers;
- integrations;
- mobile features;
- website improvements.

14. Acceptable use

- create multiple accounts to obtain repeated free trials;
- use stolen or fraudulent payment methods;
- reproduce substantial portions of our content without permission;
- use our branding, logos or trademarks in a misleading manner;
- encourage others to breach these Terms.
We reserve the right to investigate suspected misuse and cooperate with law enforcement where appropriate.
16. Artificial intelligence
Some features of Simple Sustenance use artificial intelligence (“AI”) to generate personalised meal plans, shopping lists, recipes or recommendations.
These features are intended to assist users by providing convenient suggestions based on the information they choose to provide.
Although we continually improve our AI systems, you acknowledge that:
- AI-generated content may occasionally contain inaccuracies;
- recommendations may not be suitable for every individual;
- recipes or ingredient suggestions may not always reflect local availability;
- nutritional information may vary depending on ingredients and preparation methods.
AI-generated content should be treated as guidance only.
You remain responsible for reviewing any recommendations before relying upon them.
17. Health and nutrition disclaimer
Simple Sustenance provides educational information relating to food, nutrition, recipes and meal planning.
The Service is not intended to provide:

- healthcare services;

18. Allergies and dietary information

Ingredient manufacturers may change formulations without notice.
Cross-contamination may also occur during food production or preparation.

You remain the owner of content that you create.

This licence ends when the content is deleted, except where retention is required for legal or operational reasons.

26. Apple App Store terms
If you download the Simple Sustenance app through Apple’s App Store:
- Apple is not responsible for providing maintenance or support services for the app;
- Apple is not responsible for investigating claims relating to the app;
- Apple is a third-party beneficiary of these Terms and may enforce relevant provisions against you where applicable;
- your use of the app must comply with Apple’s App Store Terms and Conditions.
Nothing in these Terms limits Apple’s rights under its App Store policies.
27. Google Play terms
If you obtain the app through Google Play:
- your use of the app must comply with Google Play’s terms and policies;
- Google is responsible for processing payments made through Google Play;
- subscription management for Google Play purchases must be carried out through your Google account.
Nothing in these Terms affects your agreement with Google regarding purchases made through Google Play.
28. Availability of the Service
We work hard to ensure that Simple Sustenance is available whenever you need it.
However, we cannot guarantee that the Service will always be available, uninterrupted or error-free.
The Service may occasionally be unavailable due to:
- scheduled maintenance;
- emergency maintenance;
- software updates;
- hardware failures;
- internet outages;
- third-party service interruptions;
- security incidents;
- events beyond our reasonable control.
We may suspend or limit access where necessary to maintain the security, stability or integrity of the Service.
Where reasonably practicable, planned maintenance will be carried out in a manner that minimises disruption.
29. Beta features
From time to time, we may release features identified as:
- Beta;
- Early Access;
- Preview;
- Experimental.

Beta features may:

Temporary suspension does not automatically terminate your account.

You may also request deletion of your account in accordance with our Account Deletion Policy.

- you repeatedly breach these Terms;
- you engage in fraud or abuse;
- you intentionally disrupt the Service;
- your actions expose us or other users to significant legal or security risks.
Termination does not affect any rights or obligations that accrued before termination.
Any provisions that are intended to survive termination, including those relating to intellectual property, liability, dispute resolution and governing law, will continue to apply.
33. Consumer rights
Nothing in these Terms excludes, restricts or limits any statutory rights that cannot lawfully be excluded under applicable consumer protection legislation.
If you are a consumer, you continue to benefit from all mandatory rights provided by law, including rights under the Consumer Rights Act 2015 where applicable.
Where any provision of these Terms conflicts with mandatory consumer protection legislation, the applicable law shall prevail to the extent of the conflict.
34. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis.
While we make reasonable efforts to provide accurate information and a reliable service, we do not warrant that:
- the Service will always be available;
- the Service will be uninterrupted;
- all information will always be complete or accurate;
- every recipe or recommendation will meet your personal expectations;
- the Service will be free from bugs or errors;
- defects will always be corrected immediately.
We continually improve the Service but cannot guarantee perfection.
Nothing in this section limits any warranties that cannot legally be excluded.
35. Limitation of liability
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot legally be excluded.
Subject to the above, and to the fullest extent permitted by law, NK Digital Limited shall not be liable for:
- indirect losses;
- consequential losses;
- loss of profits;
- loss of revenue;
- loss of business opportunity;
- loss of goodwill;
- loss of anticipated savings;
- business interruption;
- loss of data, except where caused by our failure to take reasonable security measures.
Our total aggregate liability arising from your use of the Service shall not exceed the total amount paid by you to NK Digital Limited during the twelve months immediately preceding the event giving rise to the claim.
This limitation reflects the nature of a subscription-based digital service and forms part of the basis on which the Service is provided.
36. Your responsibility
You are responsible for ensuring that:

- your device meets the technical requirements necessary to access the Service;
- your login credentials remain confidential;

The remaining provisions shall continue in full force and effect.

By creating an account or using the Service, you agree that we may communicate with you electronically where permitted by law. These communications may include:
- account notifications;
- password reset emails;
- subscription confirmations;
- payment receipts;

Where mandatory law provides otherwise, consumers may bring proceedings in the courts of their country of residence.
47. Entire agreement
These Terms and Conditions, together with the documents referred to within them, constitute the entire agreement between you and NK Digital Limited regarding your use of Simple Sustenance.
They replace any previous agreements, understandings or representations relating to the Service.
The following documents form part of this agreement where applicable:

- Account Deletion Policy;
- Acceptable Use Policy;
- any additional policies or guidelines published within the Service.
48. Interpretation

- singular words include the plural where appropriate and vice versa;
- references to legislation include any amendments or replacement legislation in force from time to time.
Where these Terms are translated into another language, the English version shall prevail in the event of any inconsistency, unless applicable law requires otherwise.

- Service means the Simple Sustenance website, mobile applications and all associated services.
- Subscription means a paid plan providing access to premium features.
- User, you or your means any individual or organisation using the Service.
- Website means the official Simple Sustenance website and any associated domains operated by NK Digital Limited.
